    Who is a freeloader ? (Say) you started contributing $25 per month 3 months back, contributed $75 till date and I have contributed $200 till date towards two specific drive .... so a person contributing $75 calls a person contributing $200 as a freeloader !!!

    I agree. Lets not start using negative terms. People have been contributing in ways they see fit (providing info, answering questions and one-time or recurring donations).

    Having said that, IV has put the donor forums in place for a reason and has already explained the rationale behind them, so there is no point in revisiting that over and over again.

    actually it does matter, right. what happens if the dates retrogress significantly for EB2 again, because of the influx of EB3 to EB2 ports? Then EB2 folks with later priority dates will miss the boat.

    But the question is whether the EB2 folks who are missing out are getting an "unfair" deal. That is debatable.

    Let us assume that EB2 is going to be current in a year or even sooner than that. Given that situation, and arguing that about 500 people jumped ahead into line over you in to EB2 from EB3, still I do not foresee that their GC's will be approved before the people who are already in line, because

    1) as FIFO is not being followed by USCIS, probably they are processing cases based on RD,
    2) PD porting is effectively done at the time the second I-140 IS APPROVED. At I-485 stage you can only hope to PD recapture and cross your fingers after sending a no fee letter. This will surely would need additional scrutiny, hence is not a so called 'Low hanging fruit'. Even if an EB3 person wants to start his process right now, it will not be probably before a year and half to two years before he/she is ready to port, and by that time you are past the gate or significantly nearer.

    so my point of view is if you look at this thing negatively, you would have a Heartburn and related health issues, but if you are positive and an optimist you would deserve what you get.

    stay healthy! that is more important than stressing yourself on issues which in the long term do not matter really. (You will get GC on or two rears later in the worst case scenario). cheer up folks:D:D:D

    My attorney is planning to send out the paperwork on June 29 to reach by monday july 2nd , is there any problem to this, is there any risk involved in sending on 29th, is anybody else doing this ? Please respond, this is urgent.

    So long as you make sure that USPS or the courier does not deliver it before July 2nd, I don't see any problem.

    I exactly know where your statements about 2005-2006-2007 coming from. Your basic assumptions is that 2005-2006-2007 guys are those who just came to US 2-3 yrs back and now want their GC asap whereas you are waiting in line for 6-7 years...right?
    Ma'm with all due respect, that is not correct for most of the cases. There are several people who has to re-file their labor for several reasons (employer greedy, company overtaken, laid-off, company gone bankrupt etc etc.). That does not mean that 2005-2006-2007 guys are asking that they should get GC before 2001-2004 people. What most of the people need is an ability to file for AOS so that they can indepenedent of the clutches of their employers.
    I'm sure if you widen your horizon, you will be able to understand the plight of all your brothers and sisters stuck in this retrogression.

    I have MS in EE from US and working since 2001,filed my GC in 2005 May(PERM).

    However can you please tell me anyone who got GC in Eb2/Eb3(India) in 1-2 yr in the last 15 yrs?
    Exactly that is now 2006-2007 PD guys are expecting to happen a miracle, right? I mean, apply 485,EAD ASAP.

    If you guys really care about 2002-2003-2004 guys, then please please wait for OCT 07 bulletin and after that you can do anything you want. If they will retrogress the dates, then please fight but not before that.

    This is just a suggestion. If you like follow it, otherwise ignore.

    When I cancelled in Mar-09 , my experience was different. The CS was humble and only persuaded me not to leave. But the cancellation process went smooth.

    FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

    I have two labors

    PERM EB2

    Labor: Certified
    PD: Dec 06
    I-140: Filed in Premium Processing on May last week
    RFE Received: June 1st
    RFE Response Sent: June 6th
    Status: No updates from USCIS

    I-485: I can file based on the pending I-140

    PD: Jan 2004
    Labor: Noy yet Certified. Based on my case analyst at DBEC it should be certified by June 30th.

    ==========

    Question:

    1. If I file I-485 with EB2 labor. Can I use EB3 PD later for getting GC faster?

    2. Does PD matters once I-485 is filed?

    3. If I file I-485 with EB2 and then due to some reason my I-140 gets rejected what options I have?

    I-94s are submitted at the airport when you leave the country. In many cases there are no I-94s coz they have been submitted and no one thought of making copies of them before travelling out of country. I am sure I dont have all the I-94s that I ever used. I submitted them at the airport when I went out and didnt make copies.

    I think it must be ok if you dont have all of them. Can anyone advise if that's the case?

    My lawyer only asked for copy of latest I94.

    She may have copies of some of my I94s in my file from previous H1 filings , but I am sure she does not have all my I94 copies. I guess only the latest I94 is required.

    You have chance of winning lawsuit if they reject you just based on immigration status. But in USA the employment is at will basis. Both employer and employee can take that option. Last year when I got offer letter that was specified in first page that this employment is at will basis. Lawsuits are more expensive. Generally lawyers will share the benefits of compensation if they take the case freely

    now ford, gm, capitalone and I'll post mine when i hear about the explanation from legal.

    i dont know if u can sue without much written proof, or if they refused to interview you. but if you do have an interview etc., and some written proof, we may have something

    a class action lawsuit ? if a lawsuit is expensive i am sure there are some lawyers who take on cases either probono or we all pool in our money and do something...

    So attack on L1 is on the way.

    What about another plan to attack F1?

    You are NOT supposed to have immigration intent when you apply F1. So what about targeting all those F1 now, since it is very obvious that they didnt come here just to study and go back. So lets smoke them out based on their "fraud intentions".

    After that lets attack the H1 landers. Many of them landed in H1 with body shoppers, and later changed to some big american company. Lets find some thing or other against these body shoppers, and all those H1 came with these body shoppers should go back (even though they are with some other company).

    Ok. what is left.......... lets find out something bad about everybody else, except me.

    Ohh... wait a sec..... we were supposed to be "united", by this forum, not "divided".

    In that case L1fraud himself could come under radar.

    Folks,

    I would like to run a questions by you guys/gals. I am getting ready to file my I-485 application. My lawyer requested that I find all copies of my I-20, OPT EAD, H1-B's etc. My question is do we have to submit copies of I-20, and OPT EAD for the Adjustment of status (I-485) stage ? Please let me know what you think ?

    I-20 is from a university that accept students in the US. The F1 student visa is issued based on the I-20.

    Let me help you understand why I think your question reeks not only of idiocracy, but also utter disregard for even basic moral and common sense.

    You wanted to buy a home, live in it for 2 years, sell it and make money. Nothing wrong with it. But, now that the market if not favorable to you, think you are not responsible for payment, and want to foreclose. All I'm saying is you are responsible for your actions; the act of buying a house, making sure you take care of it (read the contract where it says you are to take care and maintain the house to a reasonable standard), paying your monthly mortgage, insuring your home, and paying back the loan with interest by the end of the loan term. You signed the contract. You were ready to reap profits by the sale if there was equity on the home. Likewise you are to assume responsibility of payment if the home value depreciates. This is common sense. This is how the world has been. This is what they teach you as a kid. Why in the world are you complaining about depreciation when you knew this is a possibility when you bought the house?????????????????

    Foreclosing is not illegal. But in your case it is unethical. I'm not even sure if your lender will let you foreclose when you don't have a real financial burden to make regular payments. You are losing 20Gs only. I assume you are capable of paying your monthly payments. You want to relocate to get a better paying job. I do not think the lender will let you of the hook so easily. And why should they? They shouldn't. They should make you pay every single penny that you owe to them!

    And your questions about returning items to the store; you prove again that your a dishonest man! No, you cannot return a used item. It is wrong. Nothing legal about it. Who told you it is legal??? Now you may go back to the store and pretend like you didn't use it, or that the item is defective, and pass it off, but that's YOU!!!! In your own little dishonest mind everything that is in normal circumstances considered wrong is perfectly fine! You and your buddies here like "kumar1", "leo2606", think that it is fine to return used merchandise. You are all a bunch of dishonest people who didn't learn about right and wrong while growing up.
